Herbert is listed as being killed in action on 13 Jul 1916 during the attack on Trones Wood. The war diary for the Company is transcribed below and Herbert was killed at some stage during these operations:

13th Jul 1916 - Copse Ravine:- Division HQ moved to COPSE RAVINE taking over from 30th Division at point A.21.g.5.4 at 10.0am. 55th Brigade moved HQ to Copse "C"and took over from 89th Bde. 54th Brigade moved to TRIGGER WOOD. 53rd Brigade remained to GROVETOWN. Existing line to COPSE C was used but a line had to be constructed to TRIGGER WOOD for 54th Brigade and was through at 4.0pm. 58th Brigade had orders to capture TRONES WOOD; commencing the attack at 6.0pm.

13th/14th Jul 1916:- 55th Brigade attacked Trones Wood and found it so strongly defended that at 12.30am the 54th Brigade were called up from TRIGGER WOOD in support and took over COPSE C from 55th. 53rd Brigade were ordered up from GROVETOWN to relieve the 54th at 4.30aam on 14th and made their Brigade HQ at MARICOURT CHATEAU.
